MOJO SAILING / LEGAL
Terms of Service
Effective date: October 8, 2026
These Terms of Service ("Terms") govern your use of the Mojo Sailing application and the Mojo Sailing website and Course Studio (collectively, the "Services"), made available by Mojo Labs, LLC ("Mojo Labs", "we", "us"). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1. Essential marine safety disclaimer
Mojo Sailing is an aid to sailing, race preparation and situational awareness—not a certified primary navigation, collision-avoidance, emergency-response or life-safety system. The Services must not replace official nautical charts and publications, appropriately maintained navigation equipment, visual lookout, seamanship, the vessel operator's judgment, or instructions from competent authorities. You remain responsible for navigation, vessel operation, crew safety and compliance with applicable maritime rules.
2. Accuracy, availability and limitations
Positions, routes, bearings, predicted arrival times, depth, weather, winds, tides, currents, AIS targets, GPS signals, instrument feeds, maps and electronic charts can be incomplete, inaccurate, delayed, stale or unavailable. Data providers may change or interrupt service. Route recommendations can be unsafe or cross shallow water, land, restricted areas, traffic lanes or other hazards; do not follow them without independently checking current official charts, conditions and notices. Do not assume routes or calculated maneuvers are safe merely because the software displays them.
3. Racing, waypoints and Course Studio
Courses, published race coordinates, imported waypoint libraries, uploaded sailing instructions, marks, start and finish lines, and suggested sequences may contain transcription errors or represent temporary or approximate positions. Planning tool only: always verify against current official sailing instructions, notices to competitors, charts and actual marks on the water. The race committee's official instructions, signals and applicable racing rules take precedence over content in the Services. You are responsible for selecting, ordering and validating waypoints, and for respecting the rules of the event.
4. Safety and emergency features
Man Overboard (MOB), anchor watch, AIS displays, alarms and related notifications are supplementary tools. They may fail because of device power, permissions, GPS error, background execution limits, notification settings, communications loss or other reasons. They do not summon rescue services, guarantee that a person or vessel will be found, or replace established emergency procedures, personal flotation devices, reliable alarms, or properly maintained safety equipment. In emergencies, use appropriate emergency communications and established rescue procedures.
5. Your equipment and use
You are responsible for configuring the Services, checking data units and coordinate formats, maintaining suitable hardware and connectivity, testing marine data inputs, and verifying that displayed information corresponds to your vessel. Do not operate the Services in a way that distracts from maintaining a proper lookout or safe control of the vessel. You must use the Services lawfully and respect the rights of others.
6. Third-party content and services
Some functions rely on charts, map tiles, weather forecasts, tide and current predictions, device frameworks, external websites, or other third-party information. Such materials are subject to availability, licensing, disclaimers and terms of their providers. We do not control or warrant their accuracy or continued availability. Reference to an event or race organizer does not imply its endorsement.
7. Files, exports and user content
You are responsible for course descriptions, coordinates, imported GPX or JSON files, race documents and other content you provide. You represent that you have the necessary rights to use or share it. You are responsible for reviewing exports and links before sharing them, especially if they disclose sensitive vessel or crew positions. We do not guarantee that files will be preserved or compatible with every third-party product.
8. Intellectual property and permitted use
The Services and their original software, design, branding and materials are owned by or licensed to Mojo Labs, LLC, subject to third-party rights. You may use the Services for their intended lawful purpose, but may not misappropriate our source code, branding or proprietary content. Publicly available marine and governmental data retain their respective legal status and licensing.
9. No warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF ACCURACY, FITNESS FOR A PARTICULAR PURPOSE, MERCHANTABILITY, NON-INFRINGEMENT OR UNINTERRUPTED OPERATION. Nothing in these Terms excludes warranties that cannot lawfully be excluded.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MOJO LABS, LLC AND ITS OWNERS, PERSONNEL AND SUPPLIERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROFITS OR BUSINESS, ARISING FROM USE OR INABILITY TO USE THE SERVICES. Where lawful, our total liability for claims arising from the Services will not exceed the greater of the amount paid by you for the Services in the 12 months before the claim or US $100. These limits do not apply where prohibited by law, including to liabilities that cannot legally be limited or excluded.
11. Changes and availability
We may modify, suspend or discontinue functions and update these Terms as the Services evolve, subject to applicable law. The effective date above indicates the current version. Continued use after updated Terms become effective constitutes acceptance where permitted by law.
12. Governing law
Except where consumer-protection laws require otherwise, these Terms are governed by the laws of the State of Washington, United States, without regard to conflict-of-law rules. Nothing here limits mandatory rights available under the laws of your place of residence.
13. Apple platform provisions
If you obtain the app through Apple's App Store, your use also remains subject to applicable Apple terms. These Terms are between you and Mojo Labs, LLC, not Apple. Apple is not responsible for the Services or for providing support, except as otherwise required under Apple's applicable policies or by law.
